The friendly sales representative in a builder’s model home works for the builder, not for you. Their job is to sell that community’s inventory at the best possible price and terms for the builder — they don’t owe you the same duties of loyalty, disclosure, and advocacy that your own agent does.
As of October 1, 2025, Nevada Assembly Bill 258 requires that brokerage agreements — including buyer representation agreements — be in writing before an agent can legally show you property, negotiate on your behalf, or write an offer. In practice, this means it’s more important than ever to have your own agent formally representing you before you walk into a builder’s sales office, not after you’ve already started negotiating.
One of the most common misconceptions buyers have is that hiring their own agent for new construction costs them extra out of pocket. In almost all cases, the builder pays the buyer’s agent commission as part of the deal — the same way they’d budget for their own on-site sales staff. Bringing your own representation typically costs you nothing, while giving you an advocate who is negotiating for your interests instead of the builder’s.
